Modern Conducting Academy Privacy Policy

1. Who we are and what this policy covers

Modern Conducting Academy ("MCA," "we," "us") is operated by Jaclyn Normandie, a sole proprietor doing business as Modern Conducting Academy, of 212 23rd Street, Surf City, New Jersey 08008, United States.

This policy explains what personal information we collect, why we collect it, who we share it with, and the choices you have. It applies to modernacademies.com and modernconducting.com, to the Modern Conducting Academy membership and its masterclasses, to our live online classes, and to our emails.

It does not cover the practices of an institution that purchased access on your behalf. If your school or university enrolled you, their own privacy policy governs what they do with your information.

2. Information we collect

What you give us

• Name and email address when you create an account. Required.
• Name of your school or institution when you enrol through a school membership link. Required on that form.
• A password, stored encrypted. We cannot read it.
• Billing address and tax ID, on paid and institutional purchases only, where your procurement process requires it.
• Payment card details, on paid purchases only, entered directly with our payment processor. We never see or store full card numbers.
• Anything you write to us in emails, support requests, community posts, or class questions.

What is collected automatically

When you use the site we collect your IP address, browser and device type, the pages you view, the dates and times you sign in, and your progress through the masterclasses, including which lessons you have opened and completed and how much of a video you have watched.

What institutions send us

If your school asks us to enrol people directly, it sends us a list of names and email addresses. We use that list only to create those accounts and grant access.

What we do not collect

We do not ask for and do not want government identification numbers, social security numbers, health information, or any special category of sensitive personal information. Please do not send these to us.

3. How we use information

We use personal information to:

• create and maintain your account and give you access to the masterclasses you or your institution paid for;
• save your progress so you can resume where you stopped, and issue completion certificates;
• send you the Zoom links and reminders for live masterclasses;
• answer your questions and provide technical support;
• take payment, issue receipts and invoices, and manage renewals;
• confirm that access is being used by the institution that paid for it, and detect shared or unauthorised credentials;
• report usage back to an institution that holds a site license, within the limits in Section 6;
• send you occasional emails about new masterclasses and MCA news, which you can stop at any time; and
• keep the service secure, diagnose faults, and meet our legal and tax obligations.

We do not sell personal information. We do not share it with advertisers or data brokers, and we do not use it to build advertising profiles.

We do not use your personal information, your questions, or your community posts to train artificial intelligence models, and our license agreements prohibit anyone else from using our materials that way.

Where the law requires a legal basis for processing, ours is the performance of our contract with you or your institution, our legitimate interest in running and securing the service, your consent for marketing emails and non-essential cookies, and compliance with legal obligations.

4. Who we share information with

We share personal information only with service providers who process it on our behalf, under contract, and only for the purposes below.

• Kajabi hosts our website, courses, member accounts, and email, and receives account details, progress, and activity.
• Kajabi Payments and Stripe process card payments and receive payment and billing details.
• Wistia hosts and streams our masterclass videos and receives viewing activity and technical data.
• Google Analytics tells us how the site is used and receives usage data, IP address, and cookie identifiers.
• Zoom runs our live online masterclasses and receives the name and email of attendees.
• Sentry and Datadog report errors and monitor performance and receive technical and diagnostic data.

We also disclose information where we are legally required to, to enforce our license agreements or protect our rights, and to a buyer or successor if the business is sold, in which case we will say so here first.

And we share limited information back with an institution that bought a site license, as described next.

5. Cookies and analytics

We and our providers set cookies and similar technologies on our site.

• Essential cookies keep you signed in, remember your cart and purchase, protect forms, and balance server load.
• Analytics cookies tell us which pages and classes are used and how people move through the site. These include Google Analytics and Kajabi's own product analytics.
• Payment cookies let our payment processor detect fraud during checkout.
• Performance cookies report errors and monitor site health.

We use Google Analytics. Google processes this data on our behalf and its own practices are described at policies.google.com/privacy. You can opt out of Google Analytics across all sites by installing Google's browser add-on at tools.google.com/dlpage/gaoptout.

Most browsers let you refuse or delete cookies in their settings. Blocking essential cookies will stop you from signing in or watching classes.

We do not run advertising or social media tracking pixels on our site, and we do not use cookies to build advertising profiles.

We do not currently respond to browser Do Not Track signals, because there is no agreed standard for how to interpret them.

6. What we report back to your school or university

If you enrolled through a school membership, the institution that paid for your access can ask us for a usage report. This section tells you exactly what such a report contains, so there are no surprises.

What we will share with the institution

• the names and email addresses of the people who enrolled under that institution's link or roster;
• the date each person enrolled and the date they last signed in;
• how far each person has progressed through the library, as a percentage and by completed masterclass; and
• totals and summaries for the institution as a whole.

What we will not share with the institution

• your password, which we cannot read;
• your payment details, which belong to any separate personal purchase you make;
• the content of any private message or support request you send us;
• anything about your activity in a separate personal MCA membership you hold outside the institution's license; and
• anything at all about people who did not enrol under that institution.

We provide these reports because the institution is paying for your access and is responsible under our Site License Agreement for keeping it limited to current students and staff.

If you would rather your progress not be visible to your institution, do not enrol through its link. A personal membership is separate and is never included in an institutional report.

7. How long we keep information

• Your account and progress history: while your membership is active, and for 24 months afterwards so that you keep your history if you return.
• Marketing email records: until you unsubscribe, plus a permanent suppression record so we do not email you again by mistake.
• Payment and invoice records: 7 years, as required for tax and accounting.
• Support correspondence: 24 months.
• Analytics data: 14 months.

You can ask us to delete your account sooner. We will do so unless we are required to keep a record for tax, accounting, or legal reasons, in which case we keep only what the law requires.

8. Your choices and rights

Whoever and wherever you are, you can ask us to:

• see the personal information we hold about you;
• correct anything that is wrong, or change your own name and email under My Account;
• delete your account and personal information;
• export a copy of your information in a portable format; or
• stop marketing emails, either through the unsubscribe link at the foot of any marketing email or by writing to us. You will still receive essential service messages about your account and your classes.

To exercise any of these, write to [email protected] from the email address on your account. We will respond within 30 days. We will not treat you differently for asking.

If your access was bought by an institution, deleting your account ends your access to the materials the institution paid for.

9. California residents

We extend the following to California residents as a matter of practice, whether or not we meet the thresholds that make the California Consumer Privacy Act mandatory for a business of our size.

You may ask us what categories and specific pieces of personal information we have collected about you, where we got them, why we collected them, and who we shared them with. You may ask us to correct or delete that information. You may exercise these rights without being charged a different price or given a lower level of service.

We do not sell personal information, and we do not share it for cross-context behavioural advertising. We have not done so in the preceding twelve months.

The categories we collect are identifiers such as your name and email, commercial information such as your purchases, internet activity such as your use of the site and the classes, and professional or employment information such as the school where you teach or study. Section 2 says exactly what each one is, and Section 4 says who receives it.

To make a request, write to [email protected]. You may use an authorised agent, in which case we will ask for proof of their authority.

10. International users

MCA is based in the United States and our providers store and process information in the United States. If you are outside the United States, using MCA means your information is transferred there, where privacy laws differ from those in your own country.

We have members and institutional partners outside the United States. If you are in the United Kingdom, the European Economic Area, Australia, or another region with its own data protection law, the rights in Section 8 are available to you, and you may also have the right to object to processing, to restrict it, or to complain to your local supervisory authority.

Where personal information from those regions is transferred to us, we rely on appropriate safeguards, including the standard contractual clauses our providers maintain.

11. Children and students under 18

MCA is built for conductors, music educators, and university students. It is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has created an account, write to [email protected] and we will delete it.

Schools and districts sometimes buy access for students under 18. Where that happens, our Site License Agreement makes the institution responsible for obtaining any consent and giving any notice required under applicable student privacy law, including FERPA, before enabling access. We act as a service provider to the institution for those students, we use their information only to provide the service, and we will cooperate with the institution's compliance obligations on request.

A parent, guardian, or school official may ask us to review or delete a student's information by writing to [email protected].

12. Security, changes, and contact

Security. Access to MCA requires an individual account and password. Passwords are stored encrypted and we cannot read them. Our site is served over an encrypted connection, and card payments are handled by our payment processor so that we never hold full card numbers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please use a password unique to MCA and do not share your login. If you believe your account has been accessed by someone else, tell us straight away.

Changes to this policy. We may update this policy. The effective date at the top always shows the current version. If we make a material change we will post a notice on this page, and where the change affects an institutional site license we will tell the institution in writing.
